Bruna eulogy

I just did write and post this to the myspace profile of my deadly departed friend Bruna who died on July 25th. I share this with you all as a reminder to hulk it up, don't be afraid of life and get out there and LIVE! Well, when you're done reading this, that is!

I've thought very long and hard about what to write here, and without further ado, first and foremost it is beyond depressing and casts a bleak shadow that the last time I talked to you was Sept. 6, 2004, at CBGB's. Add to that, the extraordinary tragic, and almost postshadowing if you will, passing of Hilly Cristal yesterday only makes me wonder more. For it is glaringly evident that we all shall miss you, I would be remiss and flat out wrong for not saying so. Though I am not one scared of death, it is any untimely and unwarranted one is one that leaves those survivors with a scar that never truly seems to heal. It is only in times like this, these horridly empty moments of frighteningly barren, chilling stark, harshly cruel and seemingly hopeless reminders of our own eventual mortality here in this brutal airid landscape of steel and stone, that I am drive to rise up even HARDER to continue on with life, for that is the inescapable logical choice, and I know that is what you would want us to do. I hope that those who knew you can take the same inspiration you gave anyone who knew you, the courage to ride the whirlwinds of life where ever it may take us and show no fear as you did, for that spirit of life is what TRULY makes one immortal, and Bruna, you ARE! We will NEVER EVER EVER forget you and how you were one of the few people, in this world so full of shit, that actually DID make a monumental difference and made life on this third rock from the sun a BETTER place, and that is someone which is infinitely priceless! HAIL BRUNA!

They said they had sold $900 million of securities, including four sets of structured credit products, CDOs. It represented less than 5% of their assets. Losses on the sales will be $40 million equal to their first half profit.

As you know, we reported on a Carlyle memo from February in April, which said this was coming. These are the insider Illuminists and they bagged themselves by being too greedy. This shows you the depth of the rout that has only just begun.

For months, military supply chiefs in Iraq have been screaming for replacement parts, weapons, ammo and vehicles with little being received. We are told it went to South America.

Someone is building and equipping a private Army in South America and we get to pay for it. Congress knows nothing about this.

Over 1,100 people have signed a petition calling on Clear Channel to keep KLSD's progressive format since word of the planned format change leaked out late last week. Clear Channel executives have also been deluged with thousands of e-mails, virtually all in favor of keeping Air America on the air in America's sixth largest city.

KLSD has received letters supporting KLSD progressive radio received from Senator Bernie Sanders, Democratic presidential candidate Senator Mike Gravel, and Ambassador Joe Wilson, husband of former CIA-agent Valerie Plame. . .

"I think this is another effort to shut down progressive voices where the message is most effective, especially here in a military town," said Bree Walker, an Air America host in Los Angeles and former San Diego TV newscaster who recently purchased Cindy Sheehan's ranch in Crawford, Texas. . .

A caller to an Air America program last week offered a tip that the Carlisle Group may be seeking to buy Clear Channel - a rumor that has triggered alarm throughout the progressive community. A global private equity firm based in Washington D.C., the Carlisle Group's board has included George W. Bush and his father, George H.W. Bush, former Secretary of State James Baker, and former Defense Secretary Donald Rumsfeld. The company operates several major funds and has business dealings in the defense, aerospace, energy and healthcare industries, among others.

Clear Channel, America's largest radio company with over 1,100 stations nationwide, was acquired by private equity firms Thomas H Lee Partners, Bain Capital and the company's founding family for nearly $US 19 billion in November 2006.

Sen. Larry Craig (R-Idaho) was arrested in June at a Minnesota airport by a plainclothes police officer investigating lewd conduct complaints in a men’s public restroom, according to an arrest report obtained by Roll Call Monday afternoon.

A mystery trader risks losing around $1 billion dollars after placing 245,000 put options on the Dow Jones Eurostoxx 50 index, leading many analysts to speculate that a stock market crash preceded by a new 9/11 style catastrophe could take place within the next month.

The anonymous trader only stands to make money if the market crashes by a third to a half before September 21st, which is when the put options expire. A put option is a financial contract between two parties, the buyer and the writer (seller) of the option, in which the buyer stands to benefit only if the price of the asset falls. "The sales are being referred to by market traders as "bin Laden trades" because only an event on the scale of 9-11 could make these short-sell options valuable," reports financial blogger Marc Parent. Dow Jones Financial News first reported on the story.

The trader stands to make around $2 billion from their investment should an event trigger a market crash before the third week in September.

Such a cataclysmic jolt could only happen as a result of two factors, China dumping its vast dollar reserves in reaction to the sub-prime mortgage collapse, which it has threatened to do, or a massive terror attack on the same scale or larger than 9/11.

9/11 itself was foreshadowed by unprecedented put options that were placed on United and American Airlines. Though the Securities and Exchange Commission refused to reveal who placed the options, private researchers traced the investments back to the Deutsche Bank owned Banker’s Trust, which was formerly headed by then Executive Director of the CIA, Buzzy Krongard.

Put options on Morgan Stanley and Merrill Lynch, two of the World Trade Center's most prominent occupants, also spiked in the days before 9/11.

News of the suspicious trades is dovetailed by the comments of Former US Treasury secretary Larry Summers yesterday, who told ABC News that the risk of a recession in the U.S. was greater that at any time since 9/11.

Many of these have been very minor members of the American military and as a counterbalance to their reserve or rear area tours of duty, are rabidly in favor of draconian military action, the bloodier the better. Usually these drumbeaters are too old, or too fat, to fight and have no sons of draft age.

4. George W. Bush, who is the worst president in the history of the United States and directly responsible for the huge death tolls in Iraq, is determined to rule the United States until God puts a stop to him and is even more determined to force the American people into becoming obedient, Christian and self-sacrificing lemmings who worship at his shrine and march in step.

Ted Nugent Threatens to Kill Barack Obama and Hillary Clinton During Vicious Onstage Rant


Renegade right-winger Ted Nugent recently went on a vicious onstage rant in which he threatened the lives of Democratic presidential candidates Barack Obama and Hillary Clinton. Decked out in full-on camouflage hunting gear, Nugent wielded two machine guns while raging, “Obama, he’s a piece of shit. I told him to suck on my machine gun. Hey Hillary,” he continued. “You might want to ride one of these into the sunset, you worthless bitch.” Nugent summed up his eloquent speech by screaming “freedom!”


This isn’t the first time Nugent has been caught spewing hatred. Last January, the guitarist caused a scandal for Republican Texas governor Rick Perry when he wore a Confederate flag shirt and insulted immigrants at Perry’s inauguration event. As reported in today's Washington Post, "A White House manual that came to light recently gives presidential advance staffers extensive instructions in the art of 'deterring potential protestors' from President Bush's public appearances around the country.

"Among other things, any event must be open only to those with tickets tightly controlled by organizers. Those entering must be screened in case they are hiding secret signs. Any anti-Bush demonstrators who manage to get in anyway should be shouted down by 'rally squads' stationed in strategic locations. And if that does not work, they should be thrown out."

"Thrown out." Think about that for a moment. Exercising a critical First Amendment right is such a threat to this sickeningly fearful and sneaky man, George W. Bush, that equally fearful citizens of the US are ordered to stop others from participating in an essential and patriotic act: non-violent defiance of Bush's ongoing corruption and destruction of the US Constitution.

The NAFTA Superhighway

When completed, the highway will run from Mexico City to Toronto, slicing through the heartland like a dagger sunk into a heifer at the loins and pulled clean to the throat. It will be four football fields wide, an expansive gully of concrete, noise and exhaust, swelled with cars, trucks, trains and pipelines carrying water, wires and God knows what else. Through towns large and small it will run, plowing under family farms, subdevelopments, acres of wilderness. Equipped with high-tech electronic customs monitors, freight from China, offloaded into nonunionized Mexican ports, will travel north, crossing the border with nary a speed bump, bound for Kansas City, where the cheap goods manufactured in booming Far East factories will embark on the final leg of their journey into the nation's Wal-Marts.

And this NAFTA Superhighway, as it is called, is just the beginning, the first stage of a long, silent coup aimed at supplanting the sovereign United States with a multinational North American Union.

Even as this plot unfolds in slow motion, the mainstream media are silent; politicians are in denial. Yet word is getting out. Like samizdat, info about the highway has circulated in niche media platforms old and new, on right-wing websites like WorldNetDaily, in the pages of low-circulation magazines like the John Birch Society's The New American and increasingly on the letters to the editor page of local newspapers.



"Construction of the NAFTA highway from Laredo, Texas to Canada is now underway," read a letter in the February 13 San Gabriel Valley Tribune. "Spain will own most of the toll roads that connect to the superhighway. Mexico will own and operate the Kansas City Smart Port. And NAFTA tribunal, not the U.S. Supreme Court, will have the final word in trade disputes. Will the last person please take down the flag?" There are many more where that came from. "The superhighway has the potential to cripple the West Coast economy, as well as posing an enormous security breach at our border," read a letter from the January 7 San Francisco Chronicle. "So far, there has been no public participation or debate on this important issue. Public participation and debate must begin now."

In some senses it has. Prompted by angry phone calls and e-mail from their constituents, local legislators are beginning to take action. In February the Montana state legislature voted 95 to 5 for a resolution opposing "the North American Free Trade Agreement Superhighway System" as well as "any effort to implement a trinational political, government entity among the United States, Canada, and Mexico." Similar resolutions have been introduced in eighteen other states as well as the House of Representatives, where H. Con Res. 40 has attracted, as of this writing, twenty-seven co-sponsors. Republican presidential candidates in Iowa and New Hampshire now routinely face hostile questions about the highway at candidate forums. Citing a spokesperson for the Romney campaign, the Concord Monitor reports that "the road comes up at town meetings second only to immigration policy."

Grassroots movement exposes elite conspiracy and forces politicians to respond: It would be a heartening story but for one small detail.

There's no such thing as a proposed NAFTA Superhighway.

Though opposition to the nonexistent highway is the cause célèbre of many a paranoiac, the myth upon which it rests was not fabricated out of whole cloth. Rather, it has been sewn together from scraps of fact.

Take, for instance, North America's SuperCorridor Organization (NASCO), a trinational coalition of businesses and state and local transportation agencies that, in its own words, focuses "on maximizing the efficiency of our existing transportation infrastructure to support international trade." Headquartered in borrowed office space in a Dallas law firm, the organization, which has a full-time staff of three, advocates for increased public expenditure along the main north-south Interstate routes, including new high-tech freight-tracking technology and expedited border crossings. It has had some success, landing federal money to pilot cargo management technologies and winning praise from the Bush Administration. Speaking at a NASCO conference in Texas in 2004, then-Transportation Secretary Norman Mineta congratulated the organization for its efforts. "The people in this room have vision," Mineta said. "Thinking ahead, thinking long term, you began to make aggressive plans to develop...this vital artery in our national transportation system through which so much of the NAFTA traffic flows. It flows across our nation's busiest southern border crossing in Laredo; over North America's busiest commercial crossing, the Ambassador Bridge in Detroit; and through Duluth and Pembina, North Dakota, and all the places in between."

A few years ago NASCO put on its home page a map of the United States that more or less traced the flow that Mineta describes: Drawn in bright blue, the trade route begins in Monterrey, Mexico, runs up I-35 and branches out after Kansas City, along I-29 toward Winnipeg and I-94 toward Detroit and Toronto. The colorful, cartoonlike image seemed to show right out in the open just where NASCO and its confederates planned to build the NAFTA Superhighway. It began zipping around the Internet.

The organization soon found itself besieged with angry phone calls and letters. "I think the rumor going around was that this map was a blueprint and it was drawn to scale," says NASCO executive director Tiffany Melvin. (Given the size of the route markings, that would have heralded highways fifty miles wide.) Ever since the map went live, NASCO has spent a considerable amount of time attempting to refute charges like those made by right-wing nationalist Jerome Corsi, whose recent book The Late Great USA devotes several pages to excoriating NASCO for being part of the vanguard of the highway and the coming North American Union. Until recently, NASCO's website contained the following FAQs:

VIEWED from Iraq at the tail end of a 15-month deployment, the political debate in Washington is indeed surreal. Counterinsurgency is, by definition, a competition between insurgents and counterinsurgents for the control and support of a population. To believe that Americans, with an occupying force that long ago outlived its reluctant welcome, can win over a recalcitrant local population and win this counterinsurgency is far-fetched. As responsible infantrymen and noncommissioned officers with the 82nd Airborne Division soon heading back home, we are skeptical of recent press coverage portraying the conflict as increasingly manageable and feel it has neglected the mounting civil, political and social unrest we see every day. (Obviously, these are our personal views and should not be seen as official within our chain of command.)

The claim that we are increasingly in control of the battlefields in Iraq is an assessment arrived at through a flawed, American-centered framework. Yes, we are militarily superior, but our successes are offset by failures elsewhere. What soldiers call the “battle space” remains the same, with changes only at the margins. It is crowded with actors who do not fit neatly into boxes: Sunni extremists, Al Qaeda terrorists, Shiite militiamen, criminals and armed tribes. This situation is made more complex by the questionable loyalties and Janus-faced role of the Iraqi police and Iraqi Army, which have been trained and armed at United States taxpayers’ expense.

A few nights ago, for example, we witnessed the death of one American soldier and the critical wounding of two others when a lethal armor-piercing explosive was detonated between an Iraqi Army checkpoint and a police one. Local Iraqis readily testified to American investigators that Iraqi police and Army officers escorted the triggermen and helped plant the bomb. These civilians highlighted their own predicament: had they informed the Americans of the bomb before the incident, the Iraqi Army, the police or the local Shiite militia would have killed their families.

As many grunts will tell you, this is a near-routine event. Reports that a majority of Iraqi Army commanders are now reliable partners can be considered only misleading rhetoric. The truth is that battalion commanders, even if well meaning, have little to no influence over the thousands of obstinate men under them, in an incoherent chain of command, who are really loyal only to their militias.

Similarly, Sunnis, who have been underrepresented in the new Iraqi armed forces, now find themselves forming militias, sometimes with our tacit support. Sunnis recognize that the best guarantee they may have against Shiite militias and the Shiite-dominated government is to form their own armed bands. We arm them to aid in our fight against Al Qaeda.

However, while creating proxies is essential in winning a counterinsurgency, it requires that the proxies are loyal to the center that we claim to support. Armed Sunni tribes have indeed become effective surrogates, but the enduring question is where their loyalties would lie in our absence. The Iraqi government finds itself working at cross purposes with us on this issue because it is justifiably fearful that Sunni militias will turn on it should the Americans leave.

In short, we operate in a bewildering context of determined enemies and questionable allies, one where the balance of forces on the ground remains entirely unclear. (In the course of writing this article, this fact became all too clear: one of us, Staff Sergeant Murphy, an Army Ranger and reconnaissance team leader, was shot in the head during a “time-sensitive target acquisition mission” on Aug. 12; he is expected to survive and is being flown to a military hospital in the United States.) While we have the will and the resources to fight in this context, we are effectively hamstrung because realities on the ground require measures we will always refuse — namely, the widespread use of lethal and brutal force.

Given the situation, it is important not to assess security from an American-centered perspective. The ability of, say, American observers to safely walk down the streets of formerly violent towns is not a resounding indicator of security. What matters is the experience of the local citizenry and the future of our counterinsurgency. When we take this view, we see that a vast majority of Iraqis feel increasingly insecure and view us as an occupation force that has failed to produce normalcy after four years and is increasingly unlikely to do so as we continue to arm each warring side.

Coupling our military strategy to an insistence that the Iraqis meet political benchmarks for reconciliation is also unhelpful. The morass in the government has fueled impatience and confusion while providing no semblance of security to average Iraqis. Leaders are far from arriving at a lasting political settlement. This should not be surprising, since a lasting political solution will not be possible while the military situation remains in constant flux.

The Iraqi government is run by the main coalition partners of the Shiite-dominated United Iraqi Alliance, with Kurds as minority members. The Shiite clerical establishment formed the alliance to make sure its people did not succumb to the same mistake as in 1920: rebelling against the occupying Western force (then the British) and losing what they believed was their inherent right to rule Iraq as the majority. The qualified and reluctant welcome we received from the Shiites since the invasion has to be seen in that historical context. They saw in us something useful for the moment.

Now that moment is passing, as the Shiites have achieved what they believe is rightfully theirs. Their next task is to figure out how best to consolidate the gains, because reconciliation without consolidation risks losing it all. Washington’s insistence that the Iraqis correct the three gravest mistakes we made — de-Baathification, the dismantling of the Iraqi Army and the creation of a loose federalist system of government — places us at cross purposes with the government we have committed to support.

Political reconciliation in Iraq will occur, but not at our insistence or in ways that meet our benchmarks. It will happen on Iraqi terms when the reality on the battlefield is congruent with that in the political sphere. There will be no magnanimous solutions that please every party the way we expect, and there will be winners and losers. The choice we have left is to decide which side we will take. Trying to please every party in the conflict — as we do now — will only ensure we are hated by all in the long run.

At the same time, the most important front in the counterinsurgency, improving basic social and economic conditions, is the one on which we have failed most miserably. Two million Iraqis are in refugee camps in bordering countries. Close to two million more are internally displaced and now fill many urban slums. Cities lack regular electricity, telephone services and sanitation. “Lucky” Iraqis live in gated communities barricaded with concrete blast walls that provide them with a sense of communal claustrophobia rather than any sense of security we would consider normal.

In a lawless environment where men with guns rule the streets, engaging in the banalities of life has become a death-defying act. Four years into our occupation, we have failed on every promise, while we have substituted Baath Party tyranny with a tyranny of Islamist, militia and criminal violence. When the primary preoccupation of average Iraqis is when and how they are likely to be killed, we can hardly feel smug as we hand out care packages. As an Iraqi man told us a few days ago with deep resignation, “We need security, not free food.”

In the end, we need to recognize that our presence may have released Iraqis from the grip of a tyrant, but that it has also robbed them of their self-respect. They will soon realize that the best way to regain dignity is to call us what we are — an army of occupation — and force our withdrawal.

Until that happens, it would be prudent for us to increasingly let Iraqis take center stage in all matters, to come up with a nuanced policy in which we assist them from the margins but let them resolve their differences as they see fit. This suggestion is not meant to be defeatist, but rather to highlight our pursuit of incompatible policies to absurd ends without recognizing the incongruities.

We need not talk about our morale. As committed soldiers, we will see this mission through.

Bill Nye, the harmless children's edu-tainer known as "The Science Guy," managed to offend a select group of adults in Waco, Texas at a presentation, when he suggested that the moon does not emit light, but instead reflects the light of the sun.

As even most elementary-school graduates know, the moon reflects the light of the sun but produces no light of its own.

But don't tell that to the good people of Waco, who were "visibly angered by what some perceived as irreverence," according to the Waco Tribune.

Nye was in town to participate in McLennan Community College's Distinguished Lecture Series. He gave two lectures on such unfunny and adult topics as global warming, Mars exploration, and energy consumption.

But nothing got people as riled as when he brought up Genesis 1:16, which reads: "God made two great lights -- the greater light to govern the day and the lesser light to govern the night. He also made the stars."

The lesser light, he pointed out, is not a light at all, but only a reflector.

At this point, several people in the audience stormed out in fury. One woman yelled "We believe in God!" and left with three children, thus ensuring that people across America would read about the incident and conclude that Waco is as nutty as they'd always suspected.

This story originally appeared in the Waco Tribune, but the newspaper has mysteriously pulled its story from the online version, presumably to avoid further embarassment.

This took a while for a pretty straightforward case. I have real concerns of mixing Florida's public school money with vouchers for private religious schools.

Sisters Found Guilty in Fraud Case

BARTOW | After a day and a half of deliberations, a jury found sisters Betty Mae Mitchell and Jeannette Nealy guilty of using their family's private religious school to steal money from Florida's voucher system.

Neither sister showed any reaction when the six-member jury returned its verdict Wednesday morning after a five-week trial.

Mitchell, 40, and Nealy, 39, were allowed to remain free on bail, pending the results of their pre-sentencing investigation, which will take about six weeks.

A previous trial in the case ended when a jury couldn't reach a verdict and a mistrial was declared.

Prosecutors said the women swindled about $200,000 from state and federal programs through a network of corporations, including the private religious schools Faith Christian Academy in Bartow and Cathedral of Faith Christian Academy in Lakeland.


Previously their lawyer had tried to blame the problems on bad record keeping, but I guess that $35,000 Hummer got in the way of such an argument.

..."According to Assistant State Attorney Wayne Durden, the family billed the federal government $9,000 for lunches served in June and July 2003, when the school wasn't in session. They also collected $65,000 from another federal grant program for lunches, and withdrew $18,000 in cash and then another $25,000 in cash from that program. It is not known what they spent most of the cash on, but they appear to have used the $25,000 for bail money when they were arrested in the fraud case on June 29, 2004, Durden said.

In the summer of 2003, Betty Mitchell purchased a used 2003 Hummer H2 with $35,000 in cash that was taken from state scholarship funds, according to Durden.

The state has also alleged that Nealy bought a 1990 Lexus L400 in December 2003 using cash that was deposited into the account of Restoration NOW ministries, which is run by the family. The students were disabled and exceptional-education students, and the state paid the school a certain amount of money per child who attended.

Betty Mae Jives Mitchell, then Betty Clark, and Louise Henry were accused in 1987 of poisoning Mitchell's former husband, Thomas Joseph Clark, with arsenic in Crittenden County, Ark. The trial ended in a hung jury, and the state dropped its case against the pair.


I 'm pretty sure there are still types of vouchers which allow public tax money to go to private religious schools, with little oversight of the students' progress. Either way, this shit has GOT TO GO.

Actor tells Vanity Fair he's skeptical of lone shooter theory


In a new magazine interview, Bruce Willis spills the beans on his skepticism that Lee Harvey Oswald acted alone in the assassination of JFK, and suggests that the some of the same criminals who killed Kennedy are still in power today.

"They still haven't caught the guy that killed [President] Kennedy," Willis told Vanity Fair's June issue, according to the New York Post.



"I'll get killed for saying this, but I'm pretty sure those guys are still in power, in some form. The entire government of the United States was co-opted," adds the Die Hard star.

So from where did Willis, a former die-hard champion of Neo-Con policy, receive his sudden wake-up call?

As we reported last year, Hollywood director Richard Linklater said he had handed out 9/11 truth DVDs on the set of Fast Food Nation, including Alex Jones' Terror Storm and Martial Law documentaries, and that they completely changed Willis' political paradigm.

"He said it put him in such a head space that he will be quiet on issues of national policy," Linklater told the Alex Jones Show.

Is Willis' comment that the people who killed Kennedy are still in power a reference to the fact that George H.W. Bush was photographed at the scene in Dealy Plaza?**

Either way, it's refreshing to see that Willis, who was vehemently pro-war and pro-Bush in the months after 9/11, has seen the light and realized that patriotism is about love of one's country, not worship of government.

Well, it turns out that Ghouliani did make cameo appearances here or there in the months following 9-11, in the manner of walking tours for visitors officials, foreign dignitaries and celebrities: 41 appearances for 29 hours total (avg. 42 minutes per visit)- this time includes meetings away from the site!

On at least three occasions, in responding to accusations that the city failed to adequately protect the health of workers in the wreckage, he has boasted that he faced comparable risks himself. In one appearance he declared that he had been in the ruins “as often, if not more” than the cleanup workers who logged hundreds of hours in the smoldering pile.

Another time he brushed aside safety claims by asserting that his long hours at the site had left him susceptible to “every health consequence that people have suffered.”

So, how much time did Mayor Giuliani spend at ground zero?

A complete record of Mr. Giuliani’s exposure to the site is not available for the chaotic six days after the attack, when he was a frequent visitor. But an exhaustively detailed account from his mayoral archive, revised after the events to account for last-minute changes on scheduled stops, does exist for the period of Sept. 17 to Dec. 16, 2001. It shows he was there for a total of 29 hours in those three months, often for short periods or to visit locations adjacent to the rubble. In that same period, many rescue and recovery workers put in daily 12-hour shifts.



Mr. Palladino said many of his members logged 30 hours in the first two days after the attacks, and most averaged more than 400 hours at ground zero and in the debris pile at the Staten Island landfill. They are among thousands who claim long-term health damage from the exposure.

The details of those weeks are important for Mr. Giuliani’s campaign as he seeks to win the Republican nomination for president. His performance in those harrowing months after the attacks has become the main pillar of his case to become the next commander in chief, and something he reminds voters of frequently in debates and speeches.

The logs illuminate in minute detail what it was like to be mayor of a damaged city seeking to regain its footing after the attacks. The more than 600 pages include unscheduled stops and time blocked out for events with his children.

The 29 hours Mr. Giuliani spent at ground zero involved 41 appearances, mostly to give tours to other officials and foreign dignitaries. Many entries include meetings away from the site before the tour. For instance, the schedule included 30 minutes on Nov. 15, 2001, for President Vladimir V. Putin of Russia, but Mr. Putin’s tour of ground zero was widely reported to have lasted 13 minutes.

Federal ID plan raises privacy concerns

(CNN) -- Americans may need passports to board domestic flights or to picnic in a national park next year if they live in one of the states defying the federal Real ID Act.

Homeland Security Secretary Michael Chertoff says there are no plans for a federal database of drivers' information.
The act, signed in 2005 as part of an emergency military spending and tsunami relief bill, aims to weave driver's licenses and state ID cards into a sort of national identification system by May 2008. The law sets baseline criteria for how driver's licenses will be issued and what information they must contain.
The Department of Homeland Security insists Real ID is an essential weapon in the war on terror, but privacy and civil liberties watchdogs are calling the initiative an overly intrusive measure that smacks of Big Brother.
More than half the nation's state legislatures have passed symbolic legislation denouncing the plan, and some have penned bills expressly forbidding compliance.
Several states have begun making arrangements for the new requirements -- four have passed legislation applauding the measure -- but even they may have trouble meeting the act's deadline.
The cards would be mandatory for all "federal purposes," which include boarding an airplane or walking into a federal building, nuclear facility or national park, Homeland Security Secretary Michael Chertoff told the National Conference of State Legislatures last week. Citizens in states that don't comply with the new rules will have to use passports for federal purposes.
"For terrorists, travel documents are like weapons," Chertoff said. "We do have a right and an obligation to see that those licenses reflect the identity of the person who's presenting it."
Chertoff said the Real ID program is essential to national security because there are presently 8,000 types of identification accepted to enter the United States.
"It is simply unreasonable to expect our border inspectors to be able to detect forgeries on documents that range from baptismal certificates from small towns in Texas to cards that purport to reflect citizenship privileges in a province somewhere in Canada," he said.
Chertoff attended the conference in Boston, Massachusetts, in part to allay states' concerns, but he had few concrete answers on funding.
The Department of Homeland Security, which estimates state and federal costs could reach $23.1 billion over 10 years, is looking for ways to lessen the burden on states, he said. On the recent congressional front, however, Chertoff could point only to an amendment killed in the Senate last month that would've provided $300 million for the program.
"There's going to be an irreducible expense that falls on you, and that's part of the shared responsibility," Chertoff told the state legislators.
Bill Walsh, senior legal fellow for the Heritage Foundation, a Washington-based conservative think tank that supports the Real ID Act, said states shouldn't be pushing for more federal dollars because, ultimately, that will mean more federal oversight -- and many complaints about cost coincide with complaints about the federal government overstepping its bounds.
"They are only being asked to do what they should've already done to protect their citizens," Walsh said, blaming arcane software and policies at state motor vehicle departments for what he called "a tremendous trafficking in state driver's licenses."
The NCSL is calling Real ID an "unfunded mandate" that could cost states up to $14 billion over the next decade, but for which only $40 million has been federally approved. The group is demanding Congress pony up $1 billion for startup costs by year's end or scrap the proposal altogether.
Everyone must visit DMV by 2013
The Real ID Act repealed a provision in the 9/11 Commission Implementation Act calling for state and federal officials to examine security standards for driver's licenses.
It called instead for states to begin issuing new federal licenses, lasting no longer than eight years, by May 11, 2008, unless they are granted an extension.
It also requires all 245 million license and state ID holders to visit their local departments of motor vehicles and apply for a Real ID by 2013. Applicants must bring a photo ID, birth certificate, proof of Social Security number and proof of residence, and states must maintain and protect massive databases housing the information.
NCSL spokesman Bill Wyatt said the requirements are "almost physically impossible." States will have to build new facilities, secure those facilities and shell out for additional equipment and personnel.
Those costs are going to fall back on the American taxpayer, he said. It might be in the form of a new transportation, motor vehicle or gasoline tax. Or you might find it tacked on to your next state tax bill. In Texas, Wyatt said, one official told him that without federal funding, the Longhorn State might have to charge its citizens more than $100 for a license.
"We kind of feel like the way they went about this is backwards," Wyatt said, explaining that states would have appreciated more input into the process. "Each state has its own unique challenges and these are best addressed at state levels. A one-size-fits-all approach to driver's licenses doesn't necessarily work."
Many states have revolted. The governors of Idaho, Maine, Montana, New Hampshire, Oklahoma, South Carolina and Washington have signed bills refusing to comply with the act. Six others have passed bills and/or resolutions expressing opposition, and 15 have similar legislation pending.
Though the NCSL says most states' opposition stems from the lack of funding, some states cited other reasons for resisting the initiative.
New Hampshire passed a House bill opposing the program and calling Real ID "contrary and repugnant" to the state and federal constitutions. A Colorado House resolution dismissed Real ID by expressing support for the war on terror but "not at the expense of essential civil rights and liberties of citizens of this country."
Privacy concerns raised
Colorado and New Hampshire lawmakers are not alone. Groups like the American Civil Liberties Union and Electronic Frontier Foundation say the IDs and supporting databases -- which Chertoff said would eventually be federally interconnected -- will infringe on privacy.
EFF says on its Web site that the information in the databases will lay the groundwork for "a wide range of surveillance activities" by government and businesses that "will be able to easily read your private information" because of the bar code required on each card.
The databases will provide a one-stop shop for identity thieves, adds the ACLU on its Web site, and the U.S. "surveillance society" and private sector will have access to the system "for the routine tracking, monitoring and regulation of individuals' movements and activities."
The civil liberties watchdog dubs the IDs "internal passports" and claims it wouldn't be long before office buildings, gas stations, toll booths, subways and buses begin accessing the system.
But Chertoff told legislators last week that DHS has no intention of creating a federal database, and Walsh, of the Heritage Foundation, said the ACLU's allegations are disingenuous.
States will be permitted to share data only when validating someone's identity, Walsh said.
"The federal government wouldn't have any greater access to driver's license information than it does today," Walsh said.
States have the right to refuse to comply with the program, he said, and they also have the right to continue issuing IDs and driver's licenses that don't meet Real ID requirements.
But, Walsh said, "any state that's refusing to implement this key recommendation by the 9/11 Commission, and whose state driver's licenses are as a result used in another terrorist attack, should be held responsible."
State reaction to Real ID has not been all negative. Four states have passed bills or resolutions expressing approval for the program, and 13 states have similar legislation pending (Several states have pending pieces of legislation both applauding and opposing Real ID).
Chertoff said there would be repercussions for states choosing not to comply.
"This is not a mandate," Chertoff said. "A state doesn't have to do this, but if the state doesn't have -- at the end of the day, at the end of the deadline -- Real ID-compliant licenses then the state cannot expect that those licenses will be accepted for federal purposes."
