If there's one creature that animal-rights activists should not try to save (and should instead attempt to quietly euthanize), it's a lame duck.
The House of Representatives on Monday passed the Animal Enterprise Terrorism Act, extending current federal law to specifically criminalize not only interfering with "animal enterprises" -- a commercial or academic enterprise that uses or sells animals or animal products for profit, food or fiber production, agriculture, research, or testing -- but also interfering with organizations that do business with "animal enterprises," such as their lawyers or insurance companies.
As AP says:
Violators could be sentenced up to a year in jail for economic damages of less than $10,000, and up to five years in prison if a threat produced a "reasonable fear" of bodily harm. Prison sentences of up to 10 years could result if someone is actually injured.
And while AP goes on to say that "the bill specifically condones peaceful animal rights protests," a look at the bill itself (see: HR 4239) reveals much muddier language. Instead it would allow "lawful economic disruption that results from lawful public, governmental, or business reaction to the disclosure of information about an animal enterprise," which could reasonably be interpreted to mean things like distributing information.
Sounds OK; organizations can post information about animal-rights abuses on their websites. Awesome. But even passing out leaflets while on an animal enterprise's property could be deemed "unlawful" if they don't want you there, leaving open the possibility of being prosecuted under this law for peaceful activity.
Similar scenarios would also likely be included in this broad bill: sit-ins on company property, as these too would likely be deemed illegal due to the whole trespassing issue.
So peaceful, it seems, has nothing to do with it.
Since a version of this crazy-ass bill has already been given the go-ahead by the Senate, the bill has been passed on to President Bush. Any veto predictions?

THE OCCUPATION:
The US military released data yesterday showing that the weekly number of attacks in Iraq had fallen to its lowest level since Jan. ’06. It’s the 3rd week in a row where attacks were at a reduced level.
2 Iraqi civilians were killed yesterday when US military opened fire on a car. A Shi'ite official said it was "barbaric, brutal and illegal". US officials said that an incident happened but would hot comment further.
The $50 billion dollar war funding package was shot down by Senate Republicans on Friday. If passed, it would have required President Bush to start a phased redeployment of U.S. forces within 30 days of enactment. It fell 7 votes short of the 60 needed.
In his weekly radio address Bush attacked Congress for holding up funding for the war, saying Congress was “failing to meet its responsibilities to our troops.”
Presidential hopeful Joe Biden has a 5-point plan for bringing our troops home and not leaving chaos behind.
Democrats say they will not stop trying to end the war despite repeated failures in the Senate, where 60 votes are needed to overcome Republican procedural hurdles.

Presidential hopeful Dennis Kucinich this week introduced a privileged resolution to impeach Vice President Dick Cheney.
Republicans voted to force a debate on the Cheney impeachment measure. Then Democrats voted to refer to the House Judiciary Committee, where Chairman John Conyers has expressed his reluctance to take the matter up. Republicans wanted an immediate vote with hopes to spark a HOUSE floor fight.
The vote took about an hour. Republican lawmakers credit Rep. John Shadegg (R-AZ) for coming up with the idea to try and make the Dems look bad by debating the issue of a Cheney impeachment.
The House Judiciary Committee released this statement on the Kucinich resolution to impeach Cheney.

Congressman Robert Wexler sent an email to his constituents saying he will urge the Judiciary Committee to hold immediate hearings on a Cheney impeachment.
Dennis Kucinich isn’t stopping with a resolution to impeach Cheney. He is planning on a similar resolution to impeach Bush too.
PAKISTAN: STATE OF EMERGENCY!
Pakistani Police raided the homes of opposition party leaders, lawyers were taken into custody, police confiscated the equipment of journalists covering the raid and ordered them to leave the premises, and all independent television news stations remained off the air after Pervez Musharraf declared a state of emergency and suspended the constitution.
Pakistani police beat protesting lawyers. PM Shaukat Aziz said the elections would take place on schedule, though Musharraf has not commented.
Bhutto called for a mass protest if Musharraf does not end his state of emergency and hold elections.
Bush finally called Musharraf and urged him to restore democracy, hold elections and resign from his military post.
Pakistan attorney general Malik Mohammad Qayyum has said that the elections will be held in February and the state of emergency will be lifted in 1 or 2 months.
Musharraf is planning a Feb. 15th election date. Benazir Bhutto, who was set to hold a rally today, was put under virtual house arrest with police surrounding her home and not letting her leave.

Mukasey Survives First Hurdle! The Senate Judiciary Committee approved his nomination 11-8. It now goes to the FULL SENATE.
Friday evening surprise: Schumer and Feinstein’s announcement that they would be backing Mukasey was carefully timed to avoid scrutiny.
24 former intelligence officials sent a letter to Patrick Leahy and Arlen Specter asking them not to send Mukasey’s nomination to the full Senate until he makes clear his opinion on whether waterboarding is torture.
According to John Nichols from The Nation, Mukasey is much worse than Gonzo.

Pakistani police beat protesting lawyers again yesterday. PM Shaukat Aziz said the elections would take place on schedule, though Musharraf has not commented.
The constitution has been ripped to shreds," Chaudhry said.
Bush is urging Musharraf to hold scheduled elections and give up his military post “as soon as possible” but didn’t indicate there would be any change in American policy as a result of Musharraf’s actions.
Chairman of the Senate Foreign Relations Committee Sen. Dept of Justice to approve soon?
Orbitcast.com reports that the Dept. of Justice may approve the Sirius/XM merger as early as next week. It is thought that the FCC would announce their decision 30 days later. Last week Mel Karmazin that the merger would take a day to happen after approval. Mel predicted that the merger would happen at the end of the year and now it looks like that was dead on.Report: DoJ Antitrust Chief to approve merger
Reports have come in today claiming that Thomas Barnett, Assistant Attorney General for the Department of Justice Antitrust Division will approve the Sirius-XM merger, according to a Cowen & Company note issued today.
While no official announcement has been made, the reports have sent Sirius Satellite Radio Inc. (SIRI) and XM Satellite Radio Holdings Inc. (XMSR) stock soaring up nearly 6% today, despite a relatively weaker market. According to Cowen & Company analyst Tom Watts, the Antitrust Chief's approval would come "despite a staff recommendation against the deal."
In addition, it's reported that the announcement of a decision also might arrive as early as next week.
Watts notes that the pattern of the Antitrust Chief acting contrary to his staff's recommendations would be similar to the approval of the Whirlpool-Maytag merger of 2006. The Antitrust Chief ultimately approved the Whirlpool-Maytag merger, despite that DoJ staff was reported to be positioning to block the deal.
Cowen & Company continue to expect the Sirius-XM merger to be approved, and "take encouragement" from word that a decision come as soon as next week.

PAKISTAN: STATE OF EMERGENCY!
Pakistani Police raided the homes of opposition party leaders, lawyers were taken into custody, police confiscated the equipment of journalists covering the raid and ordered them to leave the premises, and all independent television news stations remained off the air for a second straight day on Sunday after Pervez Musharraf declared a state of emergency and suspended the constitution.
Pakistan's Electronic Media Regulating Authority has banned the media from making any reports "that defame or bring into ridicule" President Pervez Musharraf, his administration or the military. If you are an editor and you violate this order you can spend a year in jail or get fined $83,000.
The US is disappointed at Musharraf’s decision of emergency rule and urges him to keep to his word of holding free elections next year and step down as chief of army staff.
Pakistani PM Shaukat Aziz is saying that Pakistani leadership is still committed to democracy and elections but there might be a bit of a time difference as to when they could take place.
Former Prime Minister Benazir Bhutto feels that this move by Musharraf is going to help extremists and lead to confrontations between the regime and the people.
Yesterday, Condi Rice said that the US would have to review the billions of dollars of aid that they give to Pakistan due to Masharraf’s declaration of a state of emergency and the suspension of the constitution. Pakistan is scheduled to receive about $800 million in economic and military assistance.

This has been is an exhilarating weekend (and today, a glorious continuation of events in Pakistan) for Dick Cheney, George Bush and the clot of neo-Fascists now in control of USA, Inc. The military dictator Bush has often called his most important non-NATO ally has declared the sort of martial law over which Cheney and the rest of these US-bred thugs can only salivate and look at with ferocious envy.
General Pervez Musharraf has suspended Pakistan's toy Constitution, declared a state of emergency, violently beaten and arrested political dissidents, rounded up leading opposition figures, ended even token acknowledgement of human rights violations, stopped the broadcasts of nearly a dozen television news stations, and announced the elections planned for early 2008 are suspended, canceled, off the table for at least the next two or three years.
Why has all this happened in the last 72 hours? Because Musharraf could feel the cold wind of the possibility of his removal from office blowing through the country. His reaction came directly from the Handbook For Dictators.
The Bush Crime Family is purple with jealousy.
Today's New York Times reports a government spokesman, Tariq Azim Khan, when asked Sunday why 500 people had been arrested, said the arrests were “preventive measures” because the people presented “a threat to future law and order.”
One imagines Lynn Cheney had to bar the bedroom door at that news, with Dick locked out. Such news gets the VP very, very excited. "Preventive detention" is as effective as Cialis in short-circuiting the erectile dysfunction with which all the BCF alpha males seem to be cursed.
The Times also reports one of General Musharraf’s main justifications for suspending the Constitution and firing the members of the Supreme Court was the need to combat extremists sympathetic to the Taliban and Al Qaeda. In his announcing the state of emergency, he blamed the Supreme Court for hampering the government’s anti-terror efforts by releasing terror suspects.
The BCF also is bat-shit envious of the controls on the news media that were reported Saturday night. The dictator issued orders that journalists who brought “ridicule or disrepute” to General Musharraf and other officials could face up to three years in prison.
The possibility of the events this weekend in Pakistan being reenacted in the US is real as long as the BCF remains in power. In fact, with each day that passes without the BCF's removal from office - peacefully and legally - that possibility is slowly morphing into probability.
